Terms and conditions for our training programs and services

Acceptance of Terms

By accessing and using Tusch brothers brewery's website and services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our training programs, website, and related services.

Training Program Enrollment

Enrollment in our training programs requires completion of our registration process and payment of applicable fees. All participants must meet our eligibility requirements, including senior executive status and corporate sponsorship for group programs.

We reserve the right to refuse enrollment or terminate participation if requirements are not met or if conduct is deemed inappropriate for the training environment.

Payment Terms and Conditions

Payment is due in full prior to program commencement unless alternative arrangements have been made in writing. Corporate invoicing is available for qualified organizations with net 30-day payment terms.

All fees are non-refundable except as specifically outlined in our cancellation policy. Prices are subject to change without notice, but confirmed enrollments will honor the original quoted price.

Cancellation and Rescheduling Policy

Cancellations made more than 30 days before the program start date are eligible for a full refund minus a $500 administrative fee. Cancellations made 15-30 days prior receive a 50% refund. No refunds are provided for cancellations made less than 15 days before the program.

We may reschedule programs due to insufficient enrollment or unforeseen circumstances. In such cases, participants may transfer to another session or receive a full refund.

Participant Responsibilities

Participants are expected to attend all sessions, actively engage in exercises, maintain confidentiality regarding other participants and proprietary training methods, and conduct themselves professionally throughout the program.

Participants must disclose any medical conditions or limitations that might affect their ability to participate in stress-testing exercises.

Intellectual Property Rights

All training materials, methodologies, assessments, and content provided during our programs are proprietary to Tusch brothers brewery and protected by copyright and trade secret laws. Participants may not reproduce, distribute, or use these materials outside the training context without written permission.

Participants retain ownership of their individual assessment results and performance data.

Confidentiality and Non-Disclosure

All participants agree to maintain strict confidentiality regarding training scenarios, other participants' performance, proprietary methodologies, and any sensitive information shared during programs.

This confidentiality obligation survives completion of the training program and continues indefinitely.

Certification and Credentials

Completion certificates are awarded only to participants who attend all sessions and meet performance standards. Certificates may not be transferred or assigned to other individuals.

We reserve the right to revoke certifications if it is discovered that they were obtained through misrepresentation or if the holder engages in conduct that reflects poorly on our program.

Limitation of Liability

Our liability for any claims arising from or related to our training programs is limited to the amount of fees paid by the participant. We are not liable for any indirect, incidental, special, or consequential damages.

Participants acknowledge that training exercises may involve stress-testing scenarios and assume responsibility for their participation.

Educational Content Disclaimer

All training content is for educational purposes only and does not constitute financial, legal, or business advice. Participants should consult with qualified professionals before making business decisions based on training content.

We make no warranties regarding the applicability of training content to specific business situations or outcomes.

Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, or other force majeure events.

In such cases, we will make reasonable efforts to reschedule programs or provide alternative arrangements.

Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of Texas, United States. Any disputes arising from these terms or our services will be resolved in the courts of Harris County, Texas.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.
